Terms & Conditions

1.1 These Terms and Conditions set out the basis on which you may access and use thelisteningspace.work (the Site).

1.2 The Site is owned and operated by Natasha Wardle trading as She Shines Again (we, us or our), Heartwood House, Street Road, Glastonbury, BA6 9EG.

1.3 By using the Site, you agree to be bound by these Terms and the policies referred to within them.

1.4 References to the Site include its associated webpages and publicly available content.

1.5 If you do not agree to these Terms, you should stop using the Site.

1.7 In these Terms, Content means the text, audio recordings, transcripts, images, graphics and other material made available through the Site.

1.8 Story means an anonymised story published as part of The Listening Space, whether in audio, transcript or other published form.

1.9 Contributor means a person who participates in a Listening Conversation or contributes material for consideration as a Story.

1.10 Privacy Policy means the policy explaining how we collect, use, store and protect personal information.

1.11 You and your mean any person accessing or using the Site or its Content.

2.1 We may update these Terms from time to time.

2.2 The version published on the Site at the time you use it will apply to your use of the Site.

2.3 The date at the top of this page shows when these Terms were last updated.

3.1 Personal information collected through your use of the Site will be handled in accordance with our Privacy Policy.

3.2 Additional privacy and consent information applies to Contributors participating in Listening Conversations and contributing Stories to The Listening Space.

3.3 Please read our Privacy Policy for information about the personal information we collect, why we collect it, how it is protected, how long it may be retained and your rights in relation to it.

4.1 You may use the Site for lawful personal, educational and internal business purposes.

4.2 You must not use the Site:

• unlawfully or fraudulently;
• to harass, threaten, abuse or harm another person;
• to attempt to identify a Contributor whose Story has been anonymised;
• to publish, disclose or circulate information which you believe identifies a Contributor;
• to interfere with the operation or security of the Site; or
• in any way that infringes the rights of another person.

4.3 You must not systematically scrape, extract, reproduce or create a database from the Stories or other Content on the Site without our prior written permission.

4.4 We may restrict or suspend access to the Site where reasonably necessary to protect the Site, its Contributors, its Content or other users.

4.5 We seek to make the Site accessible. If you experience difficulty accessing the Site, please contact support@sheshinesagain.coach.

5.1 The Site, its design and Content, including published Stories, audio recordings and transcripts, are protected by copyright and other intellectual property rights belonging to us, our licensors or other rights holders as applicable.

5.2 Nothing in these Terms transfers ownership of those rights to you.

5.3 You may access, listen to and read Content for your own personal, educational or internal business use.

5.4 Where the Site provides an explicit download facility for a Story or other Content, you may download that material for personal, non-commercial use.

5.5 Unless we give prior written permission, you must not:

• alter or edit downloaded Content;
• commercially exploit it;
• sell or license it;
• republish a Story or transcript in full;
• remove copyright or attribution notices; or
• use Content in a way which misrepresents its meaning or context.

5.6 Nothing in these Terms prevents any use of the Content that is permitted by applicable copyright law.

5.7 If you use Content in breach of these Terms, your right to use that Content may cease and we may require you to delete or destroy copies you have made.

6.1 The Listening Space invites professional women who have experienced or witnessed workplace harm to participate in a Listening Conversation and, if they choose, contribute a Story.

6.2 Booking or participating in a Listening Conversation does not by itself constitute consent for a conversation to be transcribed, developed into a Story or published.

6.3 Contributors retain the choices and controls described on the Share Your Story page and in the applicable privacy and consent information.

6.4 No Story will be published without the Contributor's approval.

6.5 Published Stories are anonymised before publication. Contributors may request removal of their published Story from The Listening Space in accordance with the process described on the Site.

6.6 With a Contributor's separate consent, we may retain their original transcript and source material securely as part of The Listening Space research archive. This material may be used to inform future research, writing and publication, including a potential book arising from The Listening Space.

6.7 Consent to publication of a Story in The Listening Space and consent to retention and use of source material for future research, writing and publication are separate choices. A Contributor may agree to one without agreeing to the other.

6.8 Contributors should avoid knowingly providing material that they do not have the right to share.

6.9 Further information about the use, retention and deletion of source material is provided in our Privacy Policy.

7.1 The Listening Space shares personal accounts of workplace experiences for listening, reflection, awareness and understanding.

7.2 Stories represent the experiences and perspectives of individual Contributors. The Listening Space does not investigate or independently verify those experiences, and publication should not be understood as a finding about the conduct of another person or organisation.

7.3 The Listening Space does not provide legal, medical, psychological, therapeutic, employment or other professional advice.

7.4 Listening Conversations are not therapy, counselling, coaching, mediation, investigation or legal advice.

7.5 Content on the Site should not be relied upon as a substitute for professional advice appropriate to your individual circumstances.

8.1 Stories may describe bullying, discrimination, harassment, intimidation, humiliation, exclusion, psychological distress and other difficult workplace experiences.

8.2 Where appropriate, we may provide content notes to help listeners make informed choices about whether and when to engage with particular Stories.

8.3 You are responsible for deciding whether particular Content is appropriate for you to listen to or read.

9.1 We take reasonable care in preparing and maintaining the Site and its Content, but we do not guarantee that all information will always be complete, current or free from errors.

9.2 Stories are personal accounts and should be understood in that context.

9.3 We do not guarantee that the Site or any particular Content will always be available.

9.4 We may update, remove, suspend or withdraw Content or any part of the Site where reasonably necessary.

9.5 A Story may be removed at the request of its Contributor.

10.1 The Site may contain links to or use services provided by third parties, including services used for scheduling, video conversations, subscriptions and other functions.

10.2 Third-party services operate under their own terms and privacy practices. We are not responsible for the content or availability of external websites or services that we do not control.

10.3 A link to another website does not necessarily mean that we endorse its content, products or services.

11.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited.

11.2 The Listening Space and its Content are provided for listening, reflection, awareness and understanding. They do not constitute legal, medical, psychological, therapeutic, employment or other professional advice, and you should not rely on them as a substitute for advice appropriate to your individual circumstances.

11.3 We will not be responsible for loss or damage arising from your reliance on Content made available through the Site where that Content is provided as personal experience, reflection or general information rather than professional advice.

11.4 We do not guarantee that the Site or any particular Story or Content will always be available. We will not be responsible for loss arising solely from the Site or particular Content being unavailable, suspended or removed.

11.5 We are not responsible for the content, availability or operation of third-party websites or services linked to or used through the Site, except where responsibility cannot lawfully be excluded.

12.1 The Listening Space is committed to treating people with dignity, equality and respect. Discrimination, harassment, intimidation, abuse or other behaviour that targets or demeans another person is not acceptable in connection with the Site or The Listening Space.

12.2 The Listening Space centres the experiences of professional women who have experienced or witnessed workplace harm. This focus reflects the purpose of the project and does not diminish the experiences or dignity of others.

13.1 Artificial intelligence tools may be used to support the development and administration of The Listening Space, including research, editing, design and other supporting activities.

13.2 The stories within The Listening Space are grounded in the contributor's own words and lived experience. AI is not used to invent experiences, determine their meaning or validity, or independently create or approve a published story. Any use of AI in supporting the editorial process remains subject to my human review and judgement.

13.3 Responsibility for the stories published and for the operation of The Listening Space remains with me.

14.1 These Terms are between you and us. No other person has any right to enforce any of these Terms under the Contracts (Rights of Third Parties) Act 1999.

15.1 This agreement and any dispute arising out of or in connection with it is governed by the laws of England and Wales.

15.2 Each of the parties submits to the exclusive jurisdiction of the courts in England and Wales.
